HeroBook ("the Service") is a personalized storytelling application that uses artificial intelligence to create stories where a child is the main character. The Service is provided through the HeroBook mobile app and the website at herobook.org.

2. Acceptance of Terms

By downloading, installing, or using HeroBook, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

3. Age Requirements

HeroBook is designed for children under 13 and must be set up and managed by a parent or legal guardian who is at least 18 years old. By using the Service, you represent that you are a parent or legal guardian of the child for whom you are creating an account.

Children may only use HeroBook under the supervision and with the consent of their parent or legal guardian.

4. Account and Onboarding

To use HeroBook, a parent or guardian must complete the onboarding process, which includes providing parental information and basic child information (name and birth month/year) used to personalize stories. You are responsible for the accuracy of the information you provide.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Attempt to gain unauthorized access to the Service or its systems.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated systems or bots to access the Service in a manner that exceeds reasonable personal use.
• Provide false or misleading information during the onboarding process.

6. Intellectual Property

All content, features, and functionality of HeroBook — including but not limited to text, graphics, logos, icons, images, audio, software, and AI-generated stories — are the property of HeroBook AI or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Stories generated by HeroBook are created for your personal, non-commercial use. You may share stories with family and friends but may not reproduce, distribute, or sell them commercially without our prior written consent.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the fullest extent permitted by law, HeroBook AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid (if any) for the Service in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time and request deletion of your data as described in our Privacy Policy.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.
